Jones v. Farmers Group, Inc., Farmers Insurance Exchange, Case No. BC412413 (Los Angeles Sup. Ct. April 23, 2009)

This is a class action on behalf of all non-exempt hourly Farmers insurance adjusters who were required to perform various tasks without compensation prior arriving at their first appointment.

 

 

For the past several years, we have been litigating a class action case against Farmers seeking to obtain overtime wages for APD Claims Reps  (Farmers insurance adjusters) who used the Service Power program.

The lawsuit alleges that the APD Claims Reps are owed overtime for preliminary activities for which they were not paid, including:

  • Booting up their computer in the morning
  • Logging on to the Farmers network
  • Accessing the Service Power program
  • Obtaining their first assignment
  • Getting driving directions
  • Downloading forms
  • Calling the body shop to verify that the car is there
  • Making first contact with the insured
  • Driving to their first assignment

We recently prevailed in the California Court of Appeal with respect to class certification and a copy of that decision (as modified) is available here for your review.
