
This is a class action lawsuit on behalf of hourly-paid employees of Whelan Event Staffing Services, Inc., for failure to pay minimum wages and overtime, as well as failure to timely pay all wages due and owing. Plaintiff alleges Defendant failed to pay employees the overtime premium rate for all hours worked over eight (8) hours in a 24-hour period. This violates NRS 608.018, which states that employees who earn less than 1 and ½ times the minimum wage and who work more than eight (8) hours in a day must be paid their overtime premium rate for all hours worked over eight (8) in 24 hours. Plaintiff alleges that the Defendant scheduled employees to work shifts without having an uninterrupted period of 16 hours or more between shifts, known as a “jammed shift”.
Plaintiff demands payment for herself and all other Class Members that Defendant pay Plaintiff and Class Members their unpaid wages for all hours and overtime hours worked during the relevant time period, together with attorneys’ fees, costs, interest, and injunctive relief, as provided by law. Plaintiff also demands sixty days of pay as continuation wage/waiting time penalties.
On July 14, 2025, the Court granted preliminary approval of the settlement. Notice of the settlement was mailed to Class Members in August 2025. The deadline for Class Members to send their claim form back to the Settlement Administrators is October 2, 2025. The hearing for Final Approval of the Settlement is scheduled for December 10, 2025.
