This is a class action case on behalf of employees of Nevada CVS Pharmacy for shift jamming; failure to pay overtime and failure to pay all wages due and owing. Plaintiff frequently worked over eight hours in a 24-hour workday: for example, working a shift in the evening hours and then returning early the next morning to work a day shift. Despite this, the Defendant failed to compensate Plaintiff at 1 and ½ times his regular rate of pay for the overtime he worked. Furthermore, Defendant maintains a “no daily overtime” policy common to all non-exempt hourly paid employees at Defendant’s locations in the state of Nevada. Therefore, Plaintiff demands for himself and all Nevada Overtime Class Members the payment of one and one-half times their “regular rate” of pay for all hours worked in excess of eight hours during the relevant period together with attorneys’ fees, costs, and interest as provided by law. Members of the class who have since quit or been discharged demand thirty days of pay as waiting penalties, together with attorney’s fees, costs, interest, and punitive damages, as provided by law.
