Deweese, et al v. ITS National LLC, Case No. 3:18-cv-00375-MMD-WGC (originally filed Second Judicial Dist. Nev. Jun. 6, 2018; removed to D. Nev. Aug. 8, 2018)

This is a collective and class action case on behalf of misclassified employees of the freight brokerage firm ITS Logistics under the federal Fair Labor Standards Act (“FLSA”) and Nevada state wage and hour law.

Plaintiffs allege that they were misclassified as exempt and were not paid the proper overtime premium pay for hours worked over eight in a workday or over 40 in a workweek.

The Parties have entered into a voluntary and confidential settlement agreement which has been preliminarily approved by the Court. Notice to employees who worked for ITS as account executives, account managers, and other inside sale positions between June 6, 2015 and March 6, 2019 instructing them how to claim their portion of the settlement or exclude themselves from the settlement was mailed in April 2019. The final approval hearing is scheduled for June 24, 2019.

So in regards to the people of Nevada vs DETR, Mark is a non-stop, guns blazing, no BS kind of attorney. This guy just doesn't back down. I'd hate to be on the wrong end of a lawsuit facing this firm. To the people who are concerned that they aren't being heard, you must realize the absolute burden that every individual case adds to the class action. I haven't had my calls or emails returned, even offered to pay for a face to face consultation, and still no response, and that's okay... I also understand that I am just one of thousands of people with the same issue. Thank you mark for representing the people of this state, and not giving into DETR's BS. Keep up the amazing work!

After listening to the video conference between the courts, DETR and Others regarding the JOKE of PUA/UI IN Nevada,

Mark Thierman spoke the truth and said everything DETR didn’t wanna hear.

For myself, PUA determined after 114 days that I’m NOW eligible for normal UI through DETR, BUT UI won’t let me file online.....

Thierman is a great representative for the people of Nevada not being being paid.

I just want to say thanks to this firm for standing up for the people of Nevada on the PUA issues that are making people suffer. To take on DETR as he is doing is quite impressive. I know I appreciate it, I am one of them suffering from DETR's lack to pay the people. He really cares about all who are suffering.
