Summary

This is a class action on behalf of all Nevada and Arizona employees of Fresh and Easy who were not paid their accrued and unused Paid Time Off (“PTO”) wages at the time of separation of employment from Fresh and Easy.

A former Fresh and Easy customer associate from Las Vegas is seeking to recover accrued and unpaid Paid Time Off (“PTO”) on behalf of all former Fresh & Easy employees who worked in Arizona and/or Nevada. Despite having promised to pay its employees all their accrued and unused PTO when they left the company, Fresh & Easy has filed for bankruptcy and refused to fulfill its promise.

Any former employee who worked for Fresh & Easy in the states of Arizona and/or Nevada has a right to file a claim in bankruptcy court to try and recover their unpaid accrued PTO.

Settled

This case settled through bankruptcy proceedings. The bankruptcy court approved payment of claims for unpaid wages by class members who received a fraction of the amount of wages owed.
