
This is a class action lawsuit on behalf of hourly-paid employees of Basanti 2 (Port of Subs) for failure to pay minimum wages and overtime, as well as failure to timely pay all wages due and owing under two theories First, Plaintiff alleges Defendant failed to provide health insurance benefits of less than 10% of employees’ total gross income. Second, in Nevada, under NRS 608.018, employees who earn less than 1 and ½ times the minimum wage and who work more than eight (8) hours in a day must be paid their overtime premium rate for all hours worked over eight (8) in 24 hours. Plaintiff alleges that the Defendant scheduled employees to work shifts without having an uninterrupted period of 16 hours or more between shifts (“jammed shift”). Plaintiff demands for herself and all other class members payment for the wages owed, waiting time penalties, and injunctive relief under Nevada law.
