
This is a nationwide collective and class action lawsuit on behalf of non-exempt, hourly paid Technicians, employed by Defendant, Goettl Home Services, Inc., for alleged failure to pay overtime wages and for failure to pay for work performed while off-the-clock before and after regularly scheduled shifts and during meal and rest breaks.
Plaintiff alleges that Technicians are required to complete unpaid work such as reviewing job assignments to determine what parts are needed, locating and ordering needed parts to complete repairs, contacting vendors and communicating with Goettl customers and technicians regarding repairs, as well as stocking their vehicles in violation of the Federal Labor Standards Act (“FLSA”) 29 U.S.C § 207 (a)(1) and for California-based employees under various California Labor Code and IWC Wage Orders.
Plaintiff also alleges that the Defendant failed to provide accurate wage statements, failed to keep accurate and complete payroll records, failed to pay wages due upon discharge, and required Plaintiff and the California Class to store company vehicles containing tools and equipment at their personal residences in violation of the California Labor Code.
Plaintiff demands payment for himself and all other Class Members, all unpaid wages for all hours and overtime hours worked, for payment for missed meal/rest periods, associated penalties, together with attorneys’ fees, costs, interest, and injunctive relief, as provided by law.
