This is a class action on behalf of hourly paid employees of Petco for violating Nevada’s daily overtime law for shift jamming.  In Nevada, under NRS 608.018, employees who earn less than 1 and ½ times the minimum wage and who work more than eight (8) hours in a day must be paid their overtime premium rate for all hours worked over eight (8) in 24 hours.  Thus, an employee who works a shift with less than 16 hours between the end of one shift and the beginning of the next shift (“jammed shift”) must be paid overtime premium pay for any hours over eight. 

Plaintiff further alleges that despite requiring Plaintiff and all of its non-exempt hourly paid employees to accurately record their meal periods, they were not accurate when they did not take a full 30-minute meal period. Nevada law states that the continuous period of work is not interrupted (therefore, wages must continue to accrue and be paid) unless an employee receives a full 30-minute meal break. 

This case was settled on an individual basis.
