This is a collective and class action lawsuit on behalf of hourly-paid patient-care employees of all Nevada PAM Health locations for failure to pay minimum wages and overtime, as well as failure to timely pay all wages due and owing due to missed, shorted and/or interrupted meal periods of less than 30 full minutes in duration. Plaintiff alleges that Defendant required Plaintiff and all of its non-exempt employees to clock out at the start of their meal breaks and to clock back in at the end of their meal breaks. Despite requiring employees to accurately record their meal breaks, Defendant failed to compensate employees who did not take a full uninterrupted 30-minute meal period, in violation of Nevada law. Plaintiff further alleges breaks of 20 minutes or less must be paid because that time is counted as time worked under federal law.
Plaintiff demands for herself and for similarly situated individuals payment from Defendant at the minimum, regular, and/or overtime rate of pay where applicable for all hours worked during the relevant time period, 60 days of pay as continuation wage/waiting time penalties, together with attorneys’ fees, costs, and interest as provided by law.
