September 28, 2021 Case Update:

On September 13, 2021, the Supreme Court of Nevada denied Plaintiffs’ petition for writ of mandamus against DETR, vacated part of the Second Judicial District Court’s Order requiring DETR to continue to pay the “start/stop” claimants, and remanded the case back to the Second Judicial District for any potential further proceedings.  The Supreme Court of Nevada did not hear oral argument but decided the case on the briefings.  The Court’s Order can be accessed here.

A status hearing has been tentatively scheduled for November 4, 2021, at 11:00 a.m., with the Honorable Judge Breslow, Second Judicial District Court.

Next Steps

Thierman Buck, LLP is reviewing any potential additional steps that can be taken to help the many claimants who continue to struggle with DETR’s CARES Act claims’ processes.

Thierman Buck, LLP is not taking individual cases against DETR in any capacity.

If you have not been paid, have had start stops, have been denied for any reason, have an overpayment notification, or any other determination you do not agree with, you must appeal that decision directly through DETR.  The typical course for the UI/PUA appeal process is:

1. Appeal through DETR portal;

2. If denied, appeal to the Board of Review through the DETR portal;

3. If denied, the Petition for Judicial Review, regardless of your appeal time, has passed.

If your appeal has been denied, you must file your own writ of mandamus in your local district court.

What is a Writ of Mandamus?

In a nutshell, it is an order from a court ordering the government official to properly fulfill their official duties or correct an abuse of discretion.  Nevada Legal Services (“NLS”) has created a fillable Writ of Mandamus for claimants to fill out and instructions on how to file it with the appropriate court.  You can access this form at:

This link includes directions on how to file in district court in the county in which you reside.  Additionally, a general FAQ section provides answers to questions you may have.

Neither Nevada Legal Services nor Thierman Buck, LLP have the resources or the capacity to file writs for you, so we strongly encourage you to use the template provided by NLS.

El 13 de septiembre de 2021, la Corte Suprema de Nevada negó la petición de los demandantes de una orden de mandamus contra DETR, anuló parte de la Orden del Tribunal del Segundo Distrito Judicial que requiere que DETR continúe pagando a los demandantes de “inicio / parada” y devolvió el caso al Segundo Distrito Judicial para cualquier posible procedimiento adicional.  La Corte Suprema de Nevada no escuchó los argumentos orales, pero decidió argumentar en los informes.  Se puede acceder a la Orden de la Corte aquí aquí.

Se ha programado tentativamente una audienciade estado para el 4 de noviembre de 2021 a las 11:00 a.m., con el Honorable Juez Breslow, Tribunal del Segundo Distrito Judicial.

Próximos Pasos

Thierman Buck, LLP no está tomando casos individuales contra DETR en ninguna

This update contains information on three specific issues:

ID.me Madness

We are getting many emails about the issues related to ID.me including but not limited to the waiver of liability, arbitration requirements, holding your information in perpetuity, and the fact that many people do not have access to the electronics required to complete the verification process. We do not have immediate plans to file another lawsuit based on DETR’s use of ID.me or the conditions ID.me places on claimants.

We encourage you to be your own best advocate and reach out to your local media and especially your State Representatives about ID.me and ongoing DETR issues specifically. The Nevada Legislature is in session and there are a few bills working their way through the legislative process specific to DETR. Read any bills pending that affect your rights. Make your voices heard. You can find your Legislator’s contact information at: https://www.leg.state.nv.us

We are aware that people are spending excruciating amounts of time and effort to speak to ID.me verification personnel but, Thierman Buck, LLP cannot advise you on what actions you should take. If you want your benefits you must try to comply with ID.me conditions and/or speak to ID.me. Write down whom you speak with, when, and what was said. Follow up with an email – create a paper trail for further potential action or appeal.

Thierman Buck Is Not Representing People With Individual Appeals

Nevada Legal Services (“NLS”) has created fillable forms to file your own Writ of Mandamus (order from a court requiring a government agency to act according to the law). Go to:

NLS has instructions and forms for both Clark and Washoe County as well as general FAQ re eligibility of unemployment benefits during the COVID-19 pandemic.

If your appeal has initially been denied, file an appeal to the Board of Appeals, and if denied there file a Writ with the district court in the county in which you live. Use the NLS forms contained in the link above.

Supreme Court of Nevada Appeal – Payne v. DETR

As of April 1, 2021, the Supreme Court of Nevada has not set oral argument or a hearing date for the appeal of the Second Judicial District Court case.
