On September 13, 2021, the Supreme Court of Nevada denied Plaintiffs’ petition for writ of mandamus against DETR, vacated part of the Second Judicial District Court’s Order requiring DETR to continue to pay the “start/stop” claimants, and remanded the case back to the Second Judicial District for any potential further proceedings. The Supreme Court of Nevada did not hear oral argument but decided the case on the briefings. The Court’s Order can be accessed here.
A status hearing has been tentatively scheduled for November 4, 2021, at 11:00 a.m., with the Honorable Judge Breslow, Second Judicial District Court.
Next Steps
Thierman Buck, LLP is reviewing any potential additional steps that can be taken to help the many claimants who continue to struggle with DETR’s CARES Act claims’ processes.
Thierman Buck, LLP is not taking individual cases against DETR in any capacity.
If you have not been paid, have had start stops, have been denied for any reason, have an overpayment notification, or any other determination you do not agree with, you must appeal that decision directly through DETR. The typical course for the UI/PUA appeal process is:
1. Appeal through DETR portal;
2. If denied, appeal to the Board of Review through the DETR portal;
3. If denied, the Petition for Judicial Review, regardless of your appeal time, has passed.
If your appeal has been denied, you must file your own writ of mandamus in your local district court.
What is a Writ of Mandamus?
In a nutshell, it is an order from a court ordering the government official to properly fulfill their official duties or correct an abuse of discretion. Nevada Legal Services (“NLS”) has created a fillable Writ of Mandamus for claimants to fill out and instructions on how to file it with the appropriate court. You can access this form at:

We are getting many emails about the issues related to ID.me including but not limited to the waiver of liability, arbitration requirements, holding your information in perpetuity, and the fact that many people do not have access to the electronics required to complete the verification process. We do not have immediate plans to file another lawsuit based on DETR’s use of ID.me or the conditions ID.me places on claimants.
We encourage you to be your own best advocate and reach out to your local media and especially your State Representatives about ID.me and ongoing DETR issues specifically. The Nevada Legislature is in session and there are a few bills working their way through the legislative process specific to DETR. Read any bills pending that affect your rights. We are aware that people are spending excruciating amounts of time and effort to speak to ID.me verification personnel but, Thierman Buck, LLP cannot advise you on what actions you should take. If you want your benefits you must try to comply with ID.me conditions and/or speak to ID.me. Write down whom you speak with, when, and what was said.
