This is a class action on behalf of hourly paid employees for violations of Nevada’s daily overtime law for shift jamming. In Nevada, under NRS 608.018, employees who earn less than 1 and ½ times the minimum wage and who work more than eight (8) hours in a day must be paid their overtime premium rate for all hours worked over eight (8) in a 24-hour period. Thus, an employee who works a shift with less than 16 hours between the end of one shift and the beginning of the next shift (“jammed shift”) must be paid overtime premium pay for any hours over eight.
Plaintiff further alleges Defendant failed to provide health insurance benefits of less than 10% of employees’ total gross income. Plaintiff demands for herself and all other Class Members that Defendant pay Plaintiff and Class Members their unpaid wages for all hours and overtime hours worked during the relevant time period, together with attorneys’ fees, costs, interest,, as provided by law and sixty days of pay as waiting time penalties
The Parties engaged in extensive months-long settlement negotiations and informal discovery and engaged in a formal mediation session. Following such extensive discussions regarding the strengths of their respective position and with the assistance of the mediator, the Parties reached a proposed class action settlement through arm’s-length negotiations.
Settlement checks were mailed to Class Members in February 2024.
